    Who Employs Temporary and Contract Staff?

    Article 9 of Cabinet Resolution No. 1 of 2022 distinguishes employment-agency activities including mediation and temporary employment and outsourcing.

    Under a temporary employment and outsourcing agency arrangement, the agency employs the worker and makes that worker available to a beneficiary. The beneficiary is the person or organisation for whom, and under whose supervision, the worker is assigned.

    Mediation uses a different structure. The agency brings the parties together without becoming part of the resulting employment relationship.

    The permit route depends on the worker’s status and the employment arrangement.

    MOHRE provides a Temporary Work Permit for work connected to a specified task and period. Employers should not assume that this permit applies to every temporary or contract staffing engagement.

    Visa sponsorship also depends on the structure used. Before appointing a staffing provider, confirm which entity will sponsor the worker where sponsorship is required and which entity will complete the relevant employment formalities.

    The employing entity and service agreement determine responsibility for salary processing and related employment administration. The UAE Government guidance on the Wage Protection System sets out the current WPS framework for establishments registered with MOHRE.

    Ask the provider to document the employing entity, permit route, visa responsibility, payroll process, WPS responsibility and employee-administration scope before the assignment begins.
